By accessing and using SpotScore (“Application”) you specifically agree to accept and comply with the following Terms of Use provided herein and updated from time to time, (“Terms”). You acknowledge and agree that these terms are between you and SpotScore LLC, located at 203 N.E. Front Street, Suite 101, Milford, Kent County DE 19963 (“Licensor”).
You are granted a revocable, limited, non-transferable right to use the Application on a product that you own or control, solely as permitted by your subscription agreement with your provider and all applicable terms contained in any relevant application store terms of use. You may only use this Application for its intended purpose. Any other use is strictly prohibited. The Application does not give you, any license or right to any copyright, patent, trademark or other intellectual property right or proprietary interest belonging to Licensor or its affiliates.
These Terms also apply to any upgrades or updates to the Application.
You agree that Licensor may collect and use technical data and related information, including location data, your name, email address, date of birth, and your agent license number, if applicable. Licensor reserves the right to change, suspend, or disable access to the Application at any time without notice or liability.
Licensor does not represent that any of the displayed and available content is appropriate. By accessing such content, you do so at your own risk and are subsequently responsible for compliance with any applicable laws.
You may be required to pay fees to access certain features of the Application. All fees are in U.S. dollars and are non-refundable. If you pay any fees with a credit card, SpotScore or its affiliate may seek pre-authorization of your credit card account before your purchase to verify that the credit card is valid and has the necessary funds or credit available to cover your purchase.
This Application may include features that allow for automatically recurring payments for periodic charges (“Subscription Service”). If you decide to activate a Subscription Service, you authorize SpotScore LLC or its affiliates to periodically charge, on a going-forward basis and until cancellation of either the recurring payments or your account, all accrued sums on the payment due date. The subscription will continue unless and until you cancel your subscription, or it is terminated. You must cancel your subscription before it renews to avoid billing of the next periodic subscription fee to your account.
THE APPLICATION AND ITS CONTENTS ARE PROVIDED “AS IS” AND LICENSOR SPECIFICALLY MAKES NO REPRESENTATION OR WARRANTY OF ANY KIND AND EXPRESSLY DISCLAIMS ALL EXPRESS AND IMPLIED WARRANTIES INCLUDING, ANY WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT, AND HEREBY DISCLAIMS ALL RESPONSIBILITY. IN NO EVENT WILL LICENSOR BE LIABLE TO YOU OR ANYONE ELSE FOR PERSONAL INJURY OR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, PUNITIVE, MORAL OR OTHER DAMAGES.
